What is personal liability?

Personal liability generally refers to a person’s responsibility to compensate for damages or injuries they cause to others, such as property damage, bodily injury, and legal expenses to defend against such legal claims. Personal liability benefits under an insurance policy are designed to protect you financially where legal claims are made against you for the payment of compensation in circumstances such as death, bodily injury or property damage to someone else.  

When it comes to personal liability in travel insurance, each insurer may have different policy terms, conditions, limits and exclusions so it is important to review the insurers Product Disclosure Statement (PDS) to determine if the policy is right for you.

What does personal liability in travel insurance cover?

At Fast Cover, the Personal Liability benefit is available, to provide cover for legal claims made against you for the payment of compensation in respect of: 

• Someone else’s death or injury, and/or 

• The physical loss of, or damage to someone else’s property 

which is caused by an accident or a series of accidents attributable to one source or originating because that occurs during your trip. 

• Your reasonable legal expenses, up to the limits set out in the benefit summary in our PDS, for settling or defending the above legal claim made against you where the legal claim is covered by the policy. 

With our Personal Liability benefit, you must not admit fault or liability for the claim or incur any legal costs without our prior written approval. 

As each individual’s circumstances are different, we will assess each claim on a case-by-case basis and in accordance with your specific circumstances, policy terms, conditions and exclusions and the Certificate of Insurance.

How much personal liability coverage does Fast Cover have?

If we approve your claim, our Personal Liability benefits have set limits to which we can cover you up to the limits in the table below. 

What does travel insurance personal liability not cover you for?

Even though it would be great to be covered for all claims against you while travelling, this is not the case in most travel insurance policies. There are policy terms, conditions, exclusions and limits that apply to our Personal Liability benefit where we will not pay. We will not pay if your claim arises out of or is for: 

• Injury to you, your travel companion, or a close relative or employee of either of you. 

• Damage to your own property in your care or control, or belonging to, or in the care or control of your close relative, or your travel companion, or an employee of either of you. 

• An unlawful, wilful or malicious act by you. 

• The ownership, custody or use of any mechanically propelled vehicle or self-propelled vehicle, including but not limited to any motor vehicle, motorcycle, moped or scooter, quad bike/Recreational all-terrain vehicle, jet ski, motorboat, hoverboard, hovercraft, Segway, bicycle, electric bicycle, or power assisted bicycle. 

• The ownership, custody or use of any firearm or weapon, aerial device, or watercraft.  

• The conduct of a business, profession or trade.  

• Any loss, damage or expenses which are covered or should have been covered under a statutory or compulsory insurance policy, statutory or compulsory insurance or compensation scheme or fund, or under workers’ compensation legislation, an industrial award or agreement, or accident compensation legislation.  

• Any fine or penalty or aggravated, punitive, exemplary, liquidated damages and any other damages resulting from the multiplication of compensatory damages.  

• Disease that is transmitted by you. 

• Any relief or recovery other than monetary amounts. 

• A contract that imposes on you a liability which you would not otherwise have. 

• Assault and/or battery committed by you or at your direction. 

• Conduct intended to cause Injury, property damage or liability with reckless disregard for the consequences of you or any person acting with your knowledge, consent or connivance. 

• For more than the applicable limits set out in the benefit summary above.  

• Operation of a drone.
